Terms & Conditions

PLEASE READ THESE TERMS OF USE ("TERMS") CAREFULLY BEFORE USING THIS WEBSITE ("SITE"). USING THIS SITE INDICATES THAT YOU HAVE READ AND ACCEPT THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THIS SITE.

No warranties

This website is provided “as is” without any representations or warranties, express or implied. Essential Webcomics makes no representations or warranties in relation to this website or the information and materials provided on this website.

Without prejudice to the generality of the foregoing paragraph, Essential Webcomics does not warrant that:

(a) this website will be constantly available, or available at all; or
(b) the information on this website is complete, true, accurate or non-misleading.

User Submissions

By submitting your article(s), artwork and webcomic(s) to Essential Webcomics, you represent and warrant that,

(a) you are the sole owner and author of the article, artwork and webcomic and own 100% of all copyrights pertaining to it, or, alternatively, you have acquired all necessary rights in your Submissions to enable you to grant to Essential Webcomics the rights in your Submissions described herein;

(b) your Submission to Essential Webcomics gives unconditional rights for us to publish your article on the website, include in our RSS feed, email newsletters, sister websites and forums. We ask publisher(s) to follow reprint rules, but you acknowledge that the enforcement of our terms of service for publishers is at your risk and cost and not ours. In other words, if someone violates your copyright – it will be 100% up to you to take legal action against those who abuse your copyright to protect your interests. If you do not agree to these terms, do not submit your article(s), artwork and webcomic(s).

(c) your Submission does not infringe the copyright, trademark, patent, trade secret, or other intellectual property rights, privacy rights, or any other legal or moral rights of any third party;

(d) your Submission does not incorporate materials from a third party web site (other than your own);

(e) your Submission does not violate any Law.

Review and Editing

All user submissions to Essential Webcomics are reviewed by our editorial team. The editorial team will provide feedback and may suggest changes. Please be open to this process, which is meant to improve the ultimate impact of your work.

Please read our editorial guidelines before submitting to save time and speed the article approval process. If your submision does not conform to the editorial guidelines, we may edit, revise, or recommend revision before publication.

There are no guarantees made that article(s), artwork and webcomic(s) will be published. We reserve the right to remove any submission at any time for any reason.

No Considerations

You acknowledge that,

(a) we do not pay for article, artwork and webcomic submissions. The primary reason for submitting your article, artwork and webcomic to Essential Webcomics is for the chance to be viewed by our target audience.

If you wish to be compensated in any way, now or in future, do not contribute or submit to Essential Webcomics.

Limitation of Liability

In no event will any of the Essential Webcomics parties be liable for:

(a) any indirect, special, consequential, punitive, or exemplary damages or

(b) any damages whatsoever (including, without limitation, those resulting from loss of revenues, lost profits, loss of goodwill, loss of use, business interruption, or other intangible losses), arising out of or in connection with the Essential Webcomics website (including, without limitation, use, inability to use, or the results of use of the Essential Webcomics website, whether such damages are based on warranty, contract, tort, statute, or any other legal theory and even if any Essential Webcomics party has been advised (or should have known) of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless the Essential Webcomics Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms. Essential Webcomics reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and, in such case, you agree to cooperate with Essential Webcomic's defense of such claim.

Modifications to these Terms

Essential Webcomics reserves the right to modify these terms & conditions at any time without prior notice.
